The Rogers Mantese & Associates, P.C. Annual Law Scholarship at the Irvin D. Reid Honors College, Wayne State University, Detroit, was awarded in September, as it has been during each Fall semester. The scholarship is created to recognize outstanding scholarship by undergraduate students with financial need whose goals are to attend Wayne State University Law School and practice law in the metropolitan Detroit area after graduation. Selected Results In Health Care Law:

Dr. Doe v. Medical Center - Oakland County Circuit Court (MI)

Nature:  Represented physician in a breach of an employment contract against former medical practice for unpaid annual bonuses.  Physician was awarded full amount owed, pre-filing and post-filing interest.

Result:  Terms of settlement are confidential.

DME Provider v. DME Managed Care Network - U.S. District Court, Eastern District of Michigan

Nature:  Represented durable medical equipment company in antitrust claims filed by a durable medical equipment provider that was excluded from a managed care network.

Result:  Court dismissed case with prejudice on a motion for summary judgment on the affidavits, deposition testimony, and other evidence on the record.

ABC Medical Provider v. XYZ Billing Company - Washtenaw County Circuit Court (MI)

Nature:  Represented medical provider in a breach of contract claim against medical billing company in claims of mismanagement, under-coding, and delinquent collections.  Discovery of key e-mails and internal documents, aggressive motion practice and other critical discovery resulted in significant settlement upon facilitation.

Result:  Settlement resulted in my client recovering several millions of dollars in damages.

Dr. Doe v. ABC Emergency Service Provider - Wayne County Circuit Court (MI)

Nature:  Represented emergency service provider in claims for breach of implied and written employment contract filed by terminated staff emergency room physician.

Result:  Court summarily dismissed the claim for breach of written contract.  The claim for breach of implied contract was facilitated by the parties for nominal reimbursement of fees to physician’s attorneys and no award of damages.
